Overstay in Thailand - sanctions are getting tougher

You don’t want to overstay in Thailand. We have warned about this before, will warn again.. 

On July 7, 2014 Thailand border services received an official instruction according to which various periods of overstay will be leading to getting into different types of black-lists (ban on visiting Thailand). On 22 of July this regulation was published on Thai Immigration Bureau's official website.

The rigidity of sanctions depends on whether the person came "to surrender" willingly or was detained. If a foreigner voluntarily shows up at the immigration office to resolve the issue with the overstay, he gets the following:

  • more than 90 days – denial of entry to Thailand for a period of 1 year; 
  • more than 1 year – denial of entry to Thailand for a period of 3 years; 
  • more than 3 years - denial of entry to Thailand for a period of 5 years; 
  • more than 5 years - denial of entry to Thailand for a period of 10 years; 
  • more than 10 years - a lifetime denial of entry to Thailand;

In case the foreigner is arrested and during the arrest it becomes clear that he has an overstay

  • less than 1 year overstay (starting from 1 day!) - denial of entry to Thailand for a period of 5 years; 
  • overstay more than 1 year - denial of entry to Thailand for a period of 10 years

There is yet no clarification for a child overstay. However, according to the current law, children are not responsible for overstay so therefore they can not be punished. We hope that the situation hasn't chaged..

P.S. By the way the old sanctions (a fine and / or imprisonment) have not been canceled. New sanctions come as a "bonus". Please take care, and dont make things complicated..
